1. ACCEPTANCE OF TERMS

By creating an account and using BioMech Coaching ("the Service"), you agree to these Terms of Service in full. If you do not agree with any part of these terms, do not use the Service. These terms form a binding legal agreement between you and BioMech Coaching.

2. THE SERVICE

BioMech Coaching provides AI-generated personalised workout and nutrition plans based on data you provide. All content generated by the Service is for informational and general wellness purposes only. Plans are produced by automated systems and do not constitute, and must not be treated as, professional medical, dietary, nutritional, or personal training advice of any kind.

3. HEALTH & NUTRITION DISCLAIMER

The workout plans, nutrition plans, calorie targets, macro recommendations, and all other content provided by BioMech Coaching are for informational purposes only. They are not a substitute for professional medical advice, clinical nutritional guidance, diagnosis, or treatment.

Before beginning any new exercise programme or making significant changes to your diet, you should consult a qualified healthcare professional — including but not limited to a medical doctor, registered dietitian, or certified personal trainer — particularly if you have any pre-existing medical conditions, injuries, allergies, intolerances, eating disorders, or other health concerns.

You acknowledge that physical exercise and dietary changes carry inherent risks, including but not limited to injury, illness, nutrient deficiency, metabolic disruption, and adverse health events. You participate in any programme suggested by BioMech Coaching entirely at your own risk.

BioMech Coaching, its operators, and its affiliates are not responsible for any injury, illness, adverse health outcome, allergic reaction, nutritional deficiency, psychological impact, or loss of any kind — whether direct, indirect, incidental, or consequential — arising from your use of the Service or your decision to follow any generated plan.

Calorie and macro targets are estimates derived from established scientific equations applied to the data you provide. Individual metabolic responses vary significantly. Results are not guaranteed and will differ between individuals.

By using the Service, you confirm that you are physically capable of engaging in exercise, that you do not have a medical condition that would make dietary changes dangerous without professional supervision, and that you have not been advised by a healthcare professional to avoid physical activity or restrictive eating. If you are in any doubt about your health or suitability for this Service, do not use it without first seeking professional medical advice.

4. USER-UPLOADED CONTENT

The Service allows you to upload photographs and images ("User Content"), including progress photos, for the purpose of tracking your physical progress over time.

By uploading User Content, you acknowledge and agree to the following:

• Voluntary upload. You choose to upload images voluntarily. You are not required to upload any photographs to use the core features of the Service.
• Your responsibility. You upload all content at your own risk and sole discretion. You are solely responsible for any User Content you upload, including its content, legality, and appropriateness.
• No liability for data incidents. BioMech Coaching takes reasonable technical measures to protect stored data. However, we expressly disclaim all liability for any unauthorised access, data breach, loss, theft, or exposure of your uploaded images or any other User Content, to the fullest extent permitted by applicable law. By uploading images, you accept this risk entirely.
• No commercial use. Your uploaded images are not sold, shared with third parties for commercial purposes, used for advertising, or used to train machine learning models.
• Ownership. You retain full ownership of any images you upload. You grant BioMech Coaching a limited, non-exclusive licence to store and display your images solely for the purpose of providing the Service to you.
• Prohibited content. You must not upload images that depict minors, are obscene, infringe any third-party rights, or are otherwise unlawful. We reserve the right to remove any content that violates these terms without notice.

If you are concerned about the security or sensitivity of photographs, we strongly recommend you do not upload them.

5. YOUR ACCOUNT

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Providing accurate information — plan quality depends directly on the accuracy of your data.
• Notifying us immediately if you suspect unauthorised access to your account.

6. ACCEPTABLE USE

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse engineer, copy, or redistribute the platform or its generated content for commercial purposes.
• Share your account with others.
• Attempt to circumvent any access controls or security measures.
• Provide deliberately false information to manipulate plan outputs.
• Upload any content that is unlawful, harmful, obscene, or infringes the rights of any third party.

7. PAYMENT & SUBSCRIPTIONS

Access to BioMech Coaching requires a paid subscription. Payments are processed securely by Stripe. Subscription fees are billed as described at the time of purchase.

No refunds will be offered for first-month subscriptions. By completing payment, you acknowledge that you have read these terms and agree to this policy. For any billing queries, contact us at coach@biomechcoaching.com.

8. INTELLECTUAL PROPERTY

The BioMech Coaching platform, including its design, code, and methodology, is owned by BioMech Coaching. The personalised plans generated for you are for your personal use only and may not be resold or redistributed.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, BioMech Coaching, its operators, directors, employees, and affiliates shall not be liable for any:

• Injury, illness, death, or adverse health outcome arising from following any generated plan.
• Adverse effects from dietary changes, calorie deficits or surpluses, macronutrient adjustments, or supplement use.
• Unauthorised access to, disclosure of, or loss of User Content including uploaded photographs.
• Data breaches, security incidents, or third-party interception of data transmitted to or stored by the Service.
• Indirect, incidental, special, consequential, or punitive damages of any kind.
• Loss of data, revenue, profits, or goodwill.

Your use of the Service and any decision to follow generated plans or upload content is entirely at your own risk. Nothing in these terms limits liability for death or personal injury caused by gross negligence or fraud where such limitation is prohibited by law.

10. NO PROFESSIONAL RELATIONSHIP

Use of BioMech Coaching does not create a professional relationship of any kind between you and BioMech Coaching. No coach-client, dietitian-client, or doctor-patient relationship is formed by your use of the Service.

11. TERMINATION

We reserve the right to suspend or terminate your account if you breach these terms. You may cancel your account at any time by contacting us. Upon termination, your access to the Service will end and your data will be deleted in accordance with our Privacy Policy.

12. GOVERNING LAW

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the relevant courts.

13. CHANGES TO TERMS

We may update these terms from time to time. We will notify you of significant changes by email. Continued use of the Service after changes constitutes acceptance of the updated terms.
